东莞商家境外抢注鞋履商标反向投诉,法院认定恶意抢注赔偿品牌 100 万元 A Dongguan merchant filed a counter-suit after illegally registering a footwear trademark overseas. The court ruled that the trademark registration was malicious and ordered the brand to pay 1 million yuan in damages.

东莞商贸公司负责人王某,在美国、东南亚多国抢注时尚鞋履品牌 Sam Edelman 近似商标,依托抢注商标在亚马逊、国内电商平台反向投诉正规授权卖家,同时线上售卖仿款鞋履。

品牌方提起商标无效诉讼及民事侵权诉讼,法院终审判决涉案境外抢注商标全部宣告无效,抢注行为属于典型恶意囤积商标牟利,判令商家停止全平台线上销售,公开登报道歉,赔偿品牌经济损失 100 万元。

法官强调,抢注商标无论注册地在境内还是境外,若回流国内电商平台实施侵权、恶意打压同行,均需承担中国商标法项下全部赔偿责任。

Wang, the head of a Dongguan trading company, preemptively registered trademarks similar to the fashion footwear brand Sam Edelman in the United States and several Southeast Asian countries. He then used these trademarks to file counter-suits against authorized sellers on Amazon and domestic e-commerce platforms, while simultaneously selling counterfeit shoes online.

The brand owner filed trademark invalidation and civil infringement lawsuits. The court's final judgment declared all the overseas trademarks registered in question invalid, deeming the preemptive registration a typical case of malicious trademark hoarding for profit. The court ordered the merchant to cease online sales across all platforms, publish a public apology, and compensate the brand for economic losses of 1 million yuan.

The judge emphasized that regardless of whether a trademark is registered domestically or internationally, if it is used to infringe on domestic e-commerce platforms or maliciously suppress competitors, the trademark owner is liable for full damages under Chinese trademark law.
