商家抢注沙特品牌商标海关拦货,法院驳回全部侵权索赔诉求 Merchants who preemptively registered Saudi trademarks led to customs interception of goods; the court rejected all infringement claims.

自然人龚某抢先在国内注册沙特本土贸易公司在先使用的图文商标,随后向海关投诉出口外贸公司,扣留印有该商标的出口纸盒、纸袋,并起诉商家索赔 55 万元。

法院审理查明,涉案商标属于恶意抢注,沙特品牌在先拥有完整美术作品著作权与海外商标使用权,龚某注册目的仅为敲诈出口商家,无真实合法经营需求。最终法院驳回龚某全部诉讼请求,认定其商标注册行为无效,无需外贸企业承担任何赔偿。

外贸出口商家提示,面对他人恶意抢注商标发起的投诉、诉讼,可提交境外品牌在先使用证据抗辩,无需被动和解赔付。

An individual surnamed Gong preemptively registered a graphic trademark in China that had been used prior to this trademark by a Saudi Arabian trading company. Gong then filed a complaint with customs against the exporting company, resulting in the seizure of export boxes and bags bearing the trademark, and sued the company for 550,000 yuan in damages.

The court found that the trademark was maliciously registered, and the Saudi brand already possessed full copyright to the artwork and the right to use the trademark overseas. Gong's registration was solely for extortion of the exporting company and had no genuine legitimate business need. Ultimately, the court dismissed all of Gong's claims, ruling the trademark registration invalid and ordering the exporting company to pay no compensation.

Exporting companies are advised that when faced with complaints or lawsuits initiated by others due to malicious trademark squatting, they can submit evidence of prior use by the overseas brand to defend themselves, avoiding the need for passive settlement and compensation payments.
