近日法国巴黎司法法院审理 Lacoste 与 SHEIN 商标纠纷案并作出临时裁定:在终审判决前,禁止 SHEIN 在欧盟范围内销售带有疑似仿冒 Lacoste 鳄鱼标识的服装、珠宝及时尚配饰;要求 SHEIN 预先支付 11 万欧元赔偿金给 Lacoste,并且在官网及 App 首页公示裁定结果为期一个月,防范消费者混淆误购。本案凸显欧盟对近似商标侵权监管趋严,跨境卖家需重视欧盟商标合规风控。

Recently, the Paris Judicial Court of France made a preliminary ruling in the trademark dispute between Lacoste and SHEIN. Pending the final judgment, SHEIN is prohibited from selling clothing, jewelry and fashion accessories with marks imitating Lacoste’s crocodile logo across the EU. SHEIN is required to pay a EUR 110,000 advance compensation to Lacoste, and publish the ruling prominently on its official website and mobile app for one month to avoid consumer confusion. This case reflects stricter EU regulation on similar trademark infringements, reminding cross-border sellers to strengthen IP compliance risk control in the EU market.
